About the Program

Minnesota Statutes Chapter 515B, the Minnesota Common Interest Ownership Act (“MCIOA”), was amended in 2017 to establish new requirements regarding preventative maintenance plans and construction defect claims. This seminar presented by Michael D. Klemm of Hellmuth & Johnson, will review the framework of rights and obligations that has been in place since 1994 and explain the new requirements in detail, with practice tips for attorneys representing developers and associations. This seminar also will explore the politics behind the amendment through review of legislative testimony, and will consider the perspectives of mayors, builders, community associations and management companies. It will also address the discrepancy between the session law and the statute regarding applicability of the new requirements to existing associations.
