The Construction and Lien Law Practice Group at Hellmuth & Johnson PLLC negotiates, drafts, reviews and enforces construction contracts. Our clients in these matters include a wide range of organizations within the construction industry, including general contractors, subcontractors, material suppliers, engineering firms and architects, and property owners.

Many of the attorneys in this practice group have practical experience in the construction industry. For example, the group's chair, attorney Blake R. Nelson, worked in his family's construction business during high school and college. He and our other attorneys with similar experience know the language and procedures used in the construction industry. This makes us especially well-positioned to understand the issues central to each contract and project.

We tailor the contract to fit the needs of our construction industry clients. In some instances, a highly sophisticated agreement is required; in others, an abbreviated version will meet the client's goals. Our contact work includes:

  • Commercial contracts: Our work in this area includes subcontractor agreements, materials supplier agreements, prime construction contracts, remodeling contracts, change orders, arbitration agreements, bid proposals, delay notices and much more.
  • Residential contracts: We draft contracts between contractors and homeowners and between general contractors and subcontractors for new construction, remodeling, extensive repairs, landscaping and any other construction project involving residential property.

Our knowledge of the construction industry allows us to streamline the process of drafting contracts so that clients in some cases do not need a new contract for every job. For example, we have developed an annual master subcontractor agreement tailored to each client's requirements. Addenda and exhibits are prepared for each job throughout the year, but the main terms are contained in the annual Subcontractor Agreement. We stay current with Minnesota law changes governing the construction industry and incorporate new requirements as soon as possible.
